Trump: My Appointees Would Have Reversed SCOTUS’ Abortion Ruling

It took three days, but presumed GOP presidential nominee Donald Trump has issued his first comments on the Supreme Court’s ruling against Texas’ health and safety rules for abortion facilities.

“There’s your first example,” Trump told conservative  radio host Mike Gallagher on Thursday morning in a discussion about the importance of appointing good Supreme Court justices. Gallagher brought up Monday’s decision, Whole Women’s Health v. Hellerstedt, prompting Trump to say, “Now if we had Scalia was living, or if Scalia was replaced by me, you wouldn’t have that. It would have been the opposite.”

The Court ruled 5-3 against Texas, meaning that if Scalia had been alive, the abortion industry would still have won 5-4.

Trump’s comments came after withering criticism  from many pro-life leaders about the garrulous candidate’s silence on the abortion case, though some defended him because he’d promised to appoint pro-life judges, even naming 11 possibilities, and defund Planned Parenthood.

However, Trump also acknowledged that appointees can be inconsistent. “You wouldn’t have seen that [ruling], and people understand that. You know, when you appoint judges, sometimes they change their mind. You had that in the case of Obamacare with John Roberts. Who would have thought that would happen?”

“I mean, who would’ve thought that could’ve happened?” continued the candidate about Roberts’ decisions in National Federation of Independent Business v. Sebelius and King v. Burwell. “He could’ve killed it twice and he didn’t. That was terrible. And that was a Bush appointment. I mean that was — that was so bad, that was so bad, what happened,” Trump said.

Trump reminded Gallagher that the 11 Supreme Court candidates he said he would consider appointing come from The Federalist Society, a group he called “the gold standard” on justices.
